1. Introduction
These terms and conditions govern using the photography client folders provided by Neal Does Art. By accessing and using the client folder, you ("client," "you," "your") agree to comply with and be bound by the following terms.

2. Access and Use
2.1 Client Folder Access: Access to the client folder is provided exclusively to the client for whom the photography services were performed. Sharing access with third parties is prohibited unless explicitly authorized by us in writing.

2.2 Personal Use: The photographs and content within the client folder are for personal use only. Without prior written consent from us, any commercial use, including but not limited to selling, licensing, or distributing the photographs, is strictly prohibited.

2.3 Download and Storage: Clients are responsible for downloading and securely storing their photographs. We will retain the client folder for a period of 6 months from the delivery date, after which it may be deleted.

3. Copyright and Licensing
3.1 Copyright: All photographs and content created by Neal Does Art are protected by copyright law. We retain full copyright ownership of all photographs unless otherwise agreed upon in writing.

3.2 Licensing: Upon full payment, we grant you a non-exclusive, non-transferable, royalty-free license to use the photographs for personal use. Unless explicitly stated, this license does not include rights for commercial use, modification, or derivative works.

4. Payment and Refunds
4.1 Payment Terms: Full payment is required before the client folder is released. The invoice provided will specify payment details and due dates.

4.2 Refunds: Due to the nature of digital photography, refunds are unavailable once the client folder has been delivered. If you are dissatisfied with the photographs, please contact us to discuss possible resolutions.

5. Privacy and Data Protection
5.1 Personal Information: We are committed to protecting your privacy. Any personal information collected during the course of our services will be used solely to deliver the agreed-upon services and will not be shared with third parties without your consent.

5.2 Data Security: We employ industry-standard security measures to protect your data. However, we cannot guarantee absolute security against all potential threats.

6. Limitation of Liability
6.1 Service Interruptions: We are not liable for any interruptions or delays in accessing the client folder due to technical issues or circumstances beyond our control.

6.2 Loss or Damage: We are not responsible for any loss or damage to photographs once they have been delivered and downloaded by the client. It is your responsibility to ensure proper storage and backup of your files.

7. Modifications and Termination
7.1 Modifications: We reserve the right to modify these terms and conditions at any time. Any changes will be communicated to you via email or through our website.

7.2 Termination: We reserve the right to terminate access to the client folder if these terms and conditions are breached. In such cases, no refunds will be issued.

8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of California. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in California.
